1. Acceptance of Terms

By accessing or using the InkSigils platform, website, and any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

InkSigils provides a studio management platform designed for tattoo and piercing professionals. The Service includes scheduling, client management, portfolio tools, payment processing, compliance features, and communications tools. Features may vary by subscription plan and may be updated, modified, or discontinued at our discretion.

3. Accounts & Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. You may not attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to the Service. You agree not to upload or transmit any viruses, malware, or other harmful code. You may not use the Service to harass, abuse, or harm another person, or to collect personal information about others without their consent.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by InkSigils and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you upload to the Service, including portfolio images, client records, and other data. By uploading content, you grant InkSigils a limited license to store, display, and process that content solely for the purpose of providing the Service to you.

6. SMS & Text Messaging

InkSigils may send SMS text messages on behalf of participating studios to clients who have opted in. Messages include automated notifications (appointment reminders, booking confirmations, aftercare tips, account alerts) sent using pre-built templates, as well as conversational messages sent by studio staff through the InkSigils unified inbox. All messages are routed through the InkSigils platform, which enforces opt-out compliance and content policies. Message and data rates may apply. Message frequency varies based on your appointment activity and studio communications. Consent to receive text messages is not required as a condition of purchase or use of InkSigils.

SMS Content Policy: Studios using the InkSigils unified inbox to send conversational messages must comply with the following content policies. Messages must be related to studio services, appointments, or client inquiries. The following content is prohibited in all SMS messages sent through the InkSigils platform: unsolicited bulk messaging or spam; deceptive, misleading, or fraudulent content; harassment, threats, or abusive language; content that violates any applicable law or regulation; messages to individuals who have not opted in or who have opted out. InkSigils reserves the right to monitor, review, and suspend messaging privileges for any studio that violates these policies. Violations may result in immediate suspension or termination of the studio's account.

7. Payment & Billing

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees as described on our pricing page. Fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). All payments are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days' notice to active subscribers.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us. We will make your data available for export for a reasonable period following termination, after which it may be permanently deleted.

9. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. InkSigils does not warrant that the Service will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, InkSigils shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in the state where InkSigils is headquartered.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, notify you via email or a prominent notice within the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
